1. Acceptance of Terms

By accessing or using the SharpWire website, application, API, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service, our Privacy Policy, and all applicable laws and regulations. If you do not agree to these Terms, you must immediately cease all use of the Service.

2. Nature of the Service

SharpWire is a sports analytics and educational platform. The Service provides statistical analysis, line movement data, probability modeling, and AI-generated commentary for informational and entertainment purposes only.

The Service does NOT:

• Place, facilitate, or process any wagers or bets
• Operate as a sportsbook, bookmaker, or betting exchange
• Guarantee any outcome of any sporting event
• Provide professional gambling, financial, or investment advice

3. Eligibility

You must be at least 18 years of age (or the age of majority in your jurisdiction) to use the Service. You are solely responsible for ensuring your use complies with all applicable laws in your jurisdiction.

4. Subscriptions and Billing

Paid subscriptions are billed on a recurring monthly basis through Stripe. You may cancel at any time — cancellation takes effect at the end of the current billing period. No refunds or credits will be issued for partial billing periods.

5. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind. We do not warrant that any data, analysis, signal, or AI-generated content is accurate, complete, reliable, or error-free. All models use simulated and estimated data that may not reflect actual market conditions.

6. Limitation of Liability

To the maximum extent permitted by law, SharpWire shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, gambling losses, or losses arising from reliance on information provided by the Service. Our total aggregate liability shall not exceed the lesser of (a) fees paid in the three months preceding the claim, or (b) $50.

7. Assumption of Risk

You expressly acknowledge and assume all risks associated with any wagering activity undertaken based on information from the Service. The Company bears zero responsibility for any gambling losses.

8. AI-Generated Content

The Service uses artificial intelligence to generate analyses and commentary. AI content may contain errors, inaccuracies, or fabricated information. It does not constitute professional advice of any kind.

9. Dispute Resolution

Any disputes shall be resolved through final and binding individual arbitration administered by the American Arbitration Association. You waive the right to a jury trial and the right to participate in a class action.

10. Governing Law

These Terms are governed by the laws of the State of Delaware without regard to conflict of law principles.
